TERMS OF SERVICE

1. OVERVIEW

This website is operated by HG Creations Haydar Ghafoor, trading as HG Creations. Throughout the site, the terms “we”, “us” and “our” refer to HG Creations.

HG Creations offers this website, including all information, tools, products and services available through the website, to you conditioned upon your acceptance of these Terms of Service.

By visiting our website and/or purchasing something from us, you agree to be bound by these Terms of Service, our Privacy Policy, Refund Policy and any other policies referenced on our website.

These Terms apply to all users of the website, including browsers, customers and purchasers.

Nothing in these Terms limits or excludes any rights that consumers have under mandatory Norwegian consumer protection law.

3. PRODUCTS

HG Creations primarily sells physical products, including 3D-printed products.

We make reasonable efforts to display our products, colours, dimensions and other characteristics accurately. However, colours may appear differently depending on your screen, lighting and device settings.

Because of the manufacturing process used for 3D-printed products, minor variations may occur between individual products.

Small layer lines, minor surface variations, seams, support marks or other characteristics normally associated with 3D printing are not necessarily defects.

Product dimensions and weights may also have minor manufacturing tolerances unless otherwise stated.

A product is considered defective where it fails to meet the requirements applicable under Norwegian consumer law, taking into account the product description, intended purpose and what the customer can reasonably expect from the product.

We reserve the right to modify or discontinue products and to limit quantities available for purchase.

4. ORDERS

By placing an order, you make an offer to purchase the selected products under these Terms.

An order becomes binding subject to applicable consumer law once it has been accepted by HG Creations.

Customers are responsible for checking their order carefully before submitting it, including:

  • product;

  • colour;

  • quantity;

  • size;

  • personalization;

  • custom text or names;

  • delivery information; and

  • other selected options.

Many of our products are produced or prepared specifically in response to customer orders. Production and order processing may therefore begin shortly after an order is placed.

Cancellation requests

HG Creations does not offer a voluntary cancellation service after an order has been placed.

If you contact us requesting cancellation, we may choose to accommodate the request where processing or production has not progressed, but we are not contractually required to provide voluntary cancellation rights.

This does not restrict any statutory withdrawal or cancellation right that applies under mandatory Norwegian law.

For customized or personalized goods that fall within a statutory exception to the right of withdrawal, cancellation or withdrawal may not be available even if production has not yet started.

HG Creations may cancel an order where reasonably necessary, including because of:

  • incorrect pricing or product information;

  • suspected fraud;

  • payment problems;

  • inability to fulfil the order;

  • stock or material availability;

  • technical errors; or

  • circumstances outside our reasonable control.

If we cancel a paid order, the amount paid for the cancelled products will be refunded.

5. CUSTOM AND PERSONALIZED PRODUCTS

Some HG Creations products are manufactured according to specifications selected or supplied by the customer.

This can include products featuring customer-selected names, text, designs, dimensions or other individual customization.

Where a product is made according to the customer's specifications or is clearly personalized within the meaning of applicable Norwegian law, the statutory right of withdrawal does not apply.

Customers must therefore carefully review all customization information before placing an order.

We are not responsible for spelling mistakes, incorrect names or other incorrect information submitted by the customer where the finished product correctly reflects the information provided with the order.

This section does not affect the customer's rights where the product itself is defective or does not correspond to what was ordered.

6. RETURNS, REFUNDS AND RIGHT OF WITHDRAWAL

6.1 No voluntary returns

HG Creations does not offer a general voluntary return, exchange or change-of-mind policy beyond rights provided by mandatory law.

A customer cannot obtain a refund merely because they:

  • changed their mind;

  • no longer want the product;

  • ordered the wrong colour, quantity or variation;

  • expected a different size despite accurate dimensions being provided;

  • entered incorrect customization information; or

  • otherwise made an incorrect purchasing decision,

except where the customer has a statutory right of withdrawal or another mandatory legal right.

6.2 Statutory right of withdrawal

Consumers purchasing online may have a statutory right of withdrawal under the Norwegian Right of Withdrawal Act (angrerettloven).

Where the statutory right applies, the customer may exercise it within the applicable statutory period, normally 14 days from receipt of the goods.

The customer must notify HG Creations clearly that they wish to exercise their statutory right of withdrawal.

Where permitted by law, the customer is responsible for the direct cost of returning the product.

The product must be returned in accordance with applicable law.

Where a customer has handled a product beyond what is necessary to establish its nature, characteristics and functioning, HG Creations may make a deduction for any reduction in value to the extent permitted by law.

6.3 Products excluded from the right of withdrawal

The statutory right of withdrawal does not apply where an applicable legal exception exists.

In particular, it does not apply to goods made according to the customer's specifications or goods that have been given a clearly personalized character, where the conditions for that statutory exception are satisfied.

This may include certain custom-name, custom-text, custom-design or individually specified products sold by HG Creations.

The applicable product page and/or checkout may identify products that are customized or personalized.

6.4 Defective, damaged or incorrect products

The right of withdrawal is separate from the customer's legal rights relating to defective goods.

If a product is defective, damaged, incorrect or otherwise does not conform to the purchase agreement, customers should contact:

Please include the order number and, where reasonably necessary to assess the issue, photographs or other information showing the problem.

HG Creations will handle valid complaints in accordance with the Norwegian Consumer Purchases Act (forbrukerkjøpsloven) and other applicable mandatory consumer legislation.

Depending on the circumstances and applicable law, remedies may include repair, replacement, price reduction or refund.

Nothing in these Terms restricts the customer's mandatory statutory complaint rights (reklamasjonsrett).

7. PRICES AND PAYMENT

Prices are displayed in the currency shown on the website.

Where required by law, prices displayed to consumers include applicable VAT and other mandatory charges, except separately identified delivery charges or other costs that cannot reasonably be calculated in advance.

Shipping charges, where applicable, are displayed during checkout before the customer completes the purchase.

The customer agrees to provide accurate and complete billing and payment information.

Payment is processed through the payment methods offered at checkout.

HG Creations may refuse or cancel transactions where there are reasonable grounds to suspect fraud, unauthorized payment use or another payment-related problem.

8. SHIPPING AND DELIVERY

Available shipping methods, prices and estimated delivery times are shown during checkout or elsewhere on the website.

Delivery estimates are estimates and may be affected by circumstances outside our reasonable control.

We are not responsible for delays caused by carriers, customs authorities, incorrect customer information, extraordinary events or other circumstances outside our reasonable control, except to the extent that responsibility cannot legally be excluded.

Where mandatory Norwegian consumer law applies, the risk of loss or damage remains with HG Creations until the customer, or a third party designated by the customer other than the carrier, has physically received the goods, except where applicable law provides otherwise.

Customers are responsible for providing complete and accurate delivery information.

Additional costs resulting from incorrect or incomplete delivery information supplied by the customer may be charged to the customer where legally permitted.

9. UNCOLLECTED AND RETURNED PACKAGES

Customers are responsible for collecting packages delivered to collection points within the carrier's collection period.

Failure to collect a package does not automatically constitute valid exercise of the statutory right of withdrawal.

If a package is returned to HG Creations because it was not collected, because the customer supplied incorrect delivery information, or because delivery could not be completed for reasons attributable to the customer, we may require payment of reasonable additional shipping or handling costs where permitted by law.

Any rights the customer has under mandatory consumer law remain unaffected.

10. PRODUCT USE AND SAFETY

Products must be used only for their intended purpose.

Customers are responsible for following any product-specific instructions, warnings or age recommendations supplied with the product.

Unless specifically described as such, HG Creations products are not designed or certified as:

  • safety equipment;

  • protective equipment;

  • medical devices;

  • load-bearing safety components; or

  • products on which personal safety should depend.

Small products or products containing small components may present a choking hazard and should be kept away from young children where appropriate.

Customers must not use a product in a way that is clearly inconsistent with its intended purpose or supplied safety information.

Nothing in this section excludes liability that cannot legally be excluded.

11. INTELLECTUAL PROPERTY

Unless otherwise stated, the website and its original content, branding, photographs, graphics, text and other materials owned by HG Creations are protected by applicable intellectual property laws.

You may use the website for personal and non-commercial purposes.

You may not reproduce, distribute, commercially exploit, republish or otherwise use HG Creations-owned website content without permission except where permitted by law.

Third-party trademarks, designs and intellectual property remain the property of their respective owners.

12. CUSTOMER-SUPPLIED CONTENT

Where customers provide names, text, images, designs or other material for customization, the customer confirms that they have the necessary rights to use that material for the requested purpose.

Customers must not submit material that infringes another person's copyright, trademark, privacy rights or other legal rights.

We may refuse orders containing unlawful, infringing, hateful, threatening or otherwise inappropriate content.

The customer remains responsible for material they submit.

13. THIRD-PARTY SERVICES

Our website may use or link to services operated by third parties, including payment providers, shipping providers and other technology providers.

HG Creations is not responsible for independent third-party websites or services except where responsibility arises under applicable law.

Customers should review the applicable terms and privacy policies of third-party services where relevant.

14. SHOPIFY

Our online store is hosted using Shopify's ecommerce platform.

Shopify provides technology that enables us to operate the online store, but purchases made from HG Creations are transactions between the customer and HG Creations.

Use of Shopify-related functionality may also involve processing of information by Shopify in accordance with applicable privacy information.

15. PRIVACY

Personal information is processed in accordance with our Privacy Policy and applicable data protection legislation, including the GDPR where applicable.

Information may be processed by service providers necessary to operate the store, process payments, fulfil orders, provide customer service and arrange delivery.

16. REVIEWS AND FEEDBACK

If you voluntarily provide a product review, suggestion or other feedback, you grant HG Creations a non-exclusive, worldwide, royalty-free right to use and display that feedback for legitimate business purposes, including displaying product reviews and improving or promoting our products, subject to applicable law.

You confirm that content you submit does not violate another person's rights or applicable law.

We may moderate or remove content where reasonably necessary, including unlawful, abusive, fraudulent, misleading or irrelevant content.

17. ERRORS AND INACCURACIES

We attempt to ensure that product descriptions, prices, availability and other information are accurate.

Occasionally, information may contain typographical mistakes, technical errors or other inaccuracies.

We reserve the right to correct errors and update information.

If an error materially affects an order already placed, we will handle the situation in accordance with applicable Norwegian contract and consumer law.

18. PROHIBITED USE

You may not use the website:

  • for unlawful purposes;

  • to infringe intellectual property rights;

  • to transmit malware or malicious code;

  • to attempt unauthorized access to the website or associated systems;

  • to collect personal information unlawfully;

  • to commit fraud;

  • to interfere with the security or operation of the website;

  • to impersonate another person; or

  • in any other manner prohibited by applicable law.

We may restrict access where reasonably necessary to protect the website, HG Creations, customers or third parties.

19. DISCLAIMER

We aim to provide accurate information about our products and services.

To the extent permitted by law, we do not guarantee that the website will always be uninterrupted, error-free or continuously available.

Products are provided according to their descriptions and applicable legal requirements.

Any disclaimers in these Terms apply only to the extent permitted by applicable law and do not limit mandatory consumer rights.

20. LIMITATION OF LIABILITY

HG Creations is responsible for its obligations to customers to the extent required by applicable law.

To the maximum extent permitted by law, HG Creations will not be liable for indirect or consequential losses that were not reasonably foreseeable at the time the purchase agreement was entered into.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by Norwegian law.

Nothing in these Terms limits the customer's rights under mandatory consumer protection legislation.

21. FORCE MAJEURE

HG Creations will not be responsible for failure or delay caused by circumstances outside our reasonable control to the extent permitted by law.

Such circumstances may include natural disasters, severe weather, war, governmental action, labour disputes, major transport disruption, widespread network outages or other extraordinary events.

We will take reasonable steps to minimize the effect of such circumstances.

Mandatory consumer rights relating to delayed or failed delivery remain unaffected.

22. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the extent necessary under applicable law.

The remaining provisions will continue to apply.

23. CHANGES TO THESE TERMS

We may update these Terms from time to time.

The Terms applicable to an order are generally the Terms in effect when the order is placed, subject to mandatory law.

The latest version will be available on our website.

Material changes will be communicated where required by law.

24. GOVERNING LAW

These Terms and purchases made from HG Creations are governed by Norwegian law.

Consumers retain any mandatory protections granted by applicable consumer legislation.

Any dispute should initially be raised directly with HG Creations so that the parties can attempt to resolve the matter.

Consumers may also have the right to submit disputes to the relevant Norwegian consumer dispute-resolution authorities.

Nothing in these Terms prevents a consumer from exercising any mandatory right regarding jurisdiction or dispute resolution.
